Following a lawsuit in the Delhi High Court, which mandated that the Tripura shop pay the American industry leader Rs 3 lakh in litigation costs, ExxonMobil Corporation, one of the largest oil and gas companies in the world, was forced to order a shopkeeper who sells automobile oils to remove "Mobil" from its name.
ExxonMobil claimed that its trademark "Mobil" is used for a variety of car, industrial, marine, and aviation lubricants as well as for other oil and petroleum goods in the lawsuit it submitted before the court earlier this year. It informed the Delhi High Court that the mark had previously been shielded against infringement by a number of court rulings, and that the Tripura store's use of the word "Mobil" in its name constituted an infringement.
In February 2022, the court issued an ex-parte ad interim injunction prohibiting the shop from using the trademark "Mobil" as part of the business name "Mahanam Mobil House." A Local Commissioner was also invited to the site by the court. The Local Commissioner removed the word "Mobil" from the board of the defendant's shop during his visit and stated in a report to the court that the defendant was not dealing with any "Mobil"-branded products.
In a ruling dated August 5, Justice Prathiba M. Singh stated that the shop's proprietor evidently used the term "Mobil" as part of its trading strategy before removing it following the Local Commissioner's visit.
