Shopify to pay $40 million in patent infringement lawsuit



A Delaware jury ruled Thursday that e-commerce platform Shopify Inc owes patent holder Express Mobile Inc $40 million for infringing three patents relating to mobile-website technology.


On Wednesday, a federal jury granted Express Mobile a lump sum and dismissed Shopify's claim that the patents were invalid. Express Mobile has sued dozens of tech companies, including Google, Meta, and Amazon, for allegedly infringing the same and other patents.

Express Mobile has sued dozens of companies for infringing on the same patents.


According to a Shopify spokeswoman, the company is "disappointed and startled" by the ruling, but it is sure that it does not infringe and "intends to continue the matter in the district court or, if necessary, on appeal."


As per Express Mobile attorney Jay Nuttall, the judgement demonstrated that the company's technology is "an important and valuable advance that was being exploited by Shopify."


Express Mobile possesses internet and mobile technology patents created by the company's creator, former IBM engineer Steven Rempell. The company claimed that Shopify's website-building tools violated its patents, which cover software for delivering content to mobile devices.


It sued Shopify in 2019 when Shopify requested a certification from the Delaware court that it did not infringe.
